en some miscalculations and human error and the real winner is Beezley, 25% Filipino and not Silva. But the latter does not take this issue lightly. She claimed there has been a "sorry tale of greed, deceit, incompetence and disloyalty and their inevitable consequences( as stated in her formal complaint)" . Silva sued the organizers and officials of Miss California USA for public humiliation it has caused her and she seeks at least $500, 000 in damages. Silva further claims that there has been some kind of racial discrimination in the pageant because she is of Mexican and Ecuadorian descent. But Miss California USA organizers denies the allegation because the real winner is part Filipino, thereby making the organization non-biased and non-racist.
